Terms of Use

1. The Service and the provider
These terms apply to the mobile app and its associated servers ("Service"). The Service appears in app stores and on your phone as Lintupassi, Fågelpass or Birdpass, depending on the phone's language. It is the same service, and these terms apply to all of the names. In these terms, Birdpass means the Service.
The provider is Matkala Studios (Business ID 3628345-2), Finland. Contact: info@birdpass.app.
2. Age limit
The Service may be used by anyone aged 13 or over. Anyone under 18 may only purchase a paid Birdpass Plus subscription with a guardian's permission.
3. Account and nickname
- You sign in with your Google or Apple account. Using the Service requires an account.
- Choose a nickname that does not reveal your real name. A nickname must not be offensive, misleading, or an impersonation of another person's name.
- The security of your account relies on your Google or Apple account. You are responsible for the use of your account.
4. Permitted use
Use the Service only in accordance with the law and these terms. You may not:
- attempt to break into the Service or disrupt its operation
- bulk-harvest the Service's content automatically or copy its database
- use the Service in a way that infringes others' rights
- deliberately enter false sightings to mislead others
5. Content and licences
- Your own sightings (date, note and location) belong to you. You grant the provider the right to store and show them to you in the Service. If you turn on your public page, you also grant the right to show them publicly as described in the privacy policy, until you turn the page off.
- Species information, texts and photos are material produced by third parties or the provider. Photo authors and licences are shown in the species' details. Photos may not be used outside the Service contrary to their licence terms.
- Map data: © OpenStreetMap contributors (open database, ODbL licence).
- The Service's software, appearance and name belong to the provider.
6. Birdpass Plus subscription
- In the free version you can save sightings for a limited number of different species and use sound identification a limited number of times a month. You can see the limits and the Plus subscription's price in the subscription view.
- The subscription is purchased through the Apple App Store or Google Play. The price, billing period and taxes are shown at the time of purchase. Payment is charged to your account with the store. The provider does not process your card details.
- The subscription renews automatically until you cancel it. Cancel it from the store's subscription settings before the current period ends. Cancelling prevents the next charge, and you keep access for the period you already paid for.
- Refunds and credits are handled by the store under its own policy, so request them directly from Apple or Google. Consumers' mandatory statutory rights remain unaffected.
- A price change takes effect only once you have been notified of it in accordance with the store's rules.
- Deleting your account does not cancel the subscription. Cancel the subscription first from the store's subscription settings.
7. Species data and moving in nature
- Species information, sound identification results, rarity estimates and texts are provided for guidance. No guarantee is given as to their accuracy, and they must not be used for safety-critical decisions.
- Move in nature at your own risk. Respect nesting peace, protected sites, everyman's rights and landowners. Do not disturb birds for the sake of a sighting or a photo.
8. Ending your account
- You can delete your account at any time from the app's Account page. Deletion removes your data in accordance with the privacy policy.
- The provider may close an account or restrict its use if you breach these terms. We will explain the reason where possible.
9. Liability
- The Service is provided as is. We aim to keep it running, but cannot promise uninterrupted or error-free operation.
- The provider is not liable for indirect damages. Liability is limited to the amount you have paid for the Service in the 12 months preceding the damage.
- These limitations do not apply to consumers' mandatory rights, nor to damage caused intentionally or by gross negligence.
10. Changes
The terms may be updated. Material changes will be announced in the app in advance. By continuing to use the Service after a change, you accept the new terms. If you do not accept them, you can stop using the Service and delete your account.
11. Governing law and disputes
These terms are governed by the law of Finland. A consumer retains the mandatory consumer-protection provisions of their country of residence. Disputes are first sought to be resolved by agreement. A consumer may also bring a dispute before the Consumer Disputes Board.
12. Languages and contact
These terms are drafted in Finnish. If a translation and the Finnish version differ, the Finnish version governs.
